Residency Requirements
To be eligible to get a divorce in Maryland, the couple has to meet the residency requirements of the state.
At least one of the parties must be a resident of Maryland for six months or more before filing the divorce petition with the court.
If the grounds for divorce occurred outside the state, either spouse must be a resident of Maryland for at least six (6) months before the petition is filed.
The plaintiff (the spouse who initiates the case) can file for the divorce in the county in which either spouse currently resides.
